Legal Theory

Legal theory, or uṣūl al-fiqh, provides a general framework or methodology for the process of inferring Sharia rulings. It deals with the evidences that can be utilised and the linguistic and hermeneutical principles for interpreting the Qur’an and sunna. From the second year, students will engage in close reading of Muḥammad Riḍā al-Muẓaffar’s Uṣūl al-Fiqh covering linguistic discussions, rational discussions and the authority of evidence. The final discussion on procedural principles will be studied using the second volume of Bāqir al-Ṣadr’s Durūs fī Ilm al-Uṣūl.
